Common Causes of Motor Vehicle Crashes

Some common causes of motor vehicle crashes include:

  • Distracted driving. Distracted driving is any activity that diverts the driver's attention away from the primary task of safe driving, increasing the risk of a crash. Distracted driving can involve visual, manual, or cognitive distractions, or a combination of these. Common examples include using cell phones, eating, adjusting the radio, or even daydreaming.

  • Unsafe Lane Changes. Changing lanes without checking blind spots or using turn signals leads to many crashes. Drivers must ensure it is safe before switching lanes.

  • Driving under the influence.  Driving under the influence of alcohol or drugs, including prescription and over-the-counter medications, impairs a driver's ability to react and increases the risk of a crash. 

What to Do Immediately Following a Crash

There are certain things you can – and should – do after being involved in motor vehicle crash.

  1. Call 9-1-1: You should call 9-1-1 immediately after a being involved in a crash. It’s best to have law enforcement write a report of what occurred. We cannot emphasize enough the importance of this call and report. Police reports may be the most crucial – and only – source for proving the other driver’s fault and negligence.

  2. Seek medical attention: Seek immediate medical care for your injuries. Insurance companies will interpret your decision not to seek prompt medical attention as a sign that you are not that injured. Like a police report, medical records will become critical in proving your injuries. We all know adrenaline masks some of our initial pains. However, do not delay in seeking the care you need.

  3. Take pictures/videos: As soon as practical after the crash, take photographs and videos of the crash scene, damaged vehicles, and your injuries. Pictures and videos are especially important if the crash occurs in an area under construction because once the construction is gone, we may not be able to show what the area looked like at the time of the crash. Pictures and videos can serve as evidence of the crash.

  4. Never speak with the insurance company: The insurance company may tell you the call is being recorded for “quality assurance.” The reason insurance companies record calls is to use your words against you later. Do not talk to any insurance company without first consulting with Acevedo Law. After you speak with us, we will contact the insurance company on your behalf.

What You Must Prove to Win

Slip and fall cases fall under the law of premises liability. Under Illinois law, an injured person must show there was a condition on the premises/property that presented an unreasonable risk of harm to the public. We must then prove the property owner knew or should have known of the condition and risk. Slip and fall cases are difficult because – unless it obvious – it is hard to show the property owners knew or should have known of the condition and risk.
